1. Acceptance of Terms
These Terms are an agreement between you and Webfort Ltd, a company registered in England and Wales under company number 15981490, whose registered office is at 128 City Road, London EC1V 2NX, United Kingdom ("Webfort", "we", "us"). By accessing or using our services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.
These Terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute arising from them. If you are a consumer, nothing in these Terms affects your statutory rights, including your rights under the Consumer Rights Act 2015.
Where these Terms conflict with our Data Processing Agreement on a data protection question, the Data Processing Agreement takes precedence.
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on our website. Your continued use of our services after such modifications constitutes your acceptance of the updated Terms.
2. Description of Services
Webfort provides web hosting services including but not limited to:
- Shared, WordPress, premium and reseller hosting
- Domain registration and management
- Email hosting services
- SSL certificates
- Website backup and security services
⚠️ Important
Service availability and features may vary depending on your chosen hosting plan. Please refer to your specific plan details for complete information about included services.
2.1 Service Level Agreement
We commit to at least 99.99% uptime for your hosting service in each calendar month. If we miss it, you are entitled to a credit under this section. This is a promise with a remedy attached, not a target we hope to reach.
What counts as downtime
Downtime is any period in which your hosting service is unreachable, measured by our external monitoring, which checks every service from multiple locations outside our network. Monthly uptime is the total minutes in the month less downtime minutes, divided by the total minutes in the month. We publish the results on our status page.
What does not count
The following are excluded from the uptime calculation:
- Scheduled maintenance, where we have given you at least 48 hours' notice by email or on the status page
- Emergency security patching, which we keep as short as we can and tell you about as soon as we can
- Faults in your own website, application, code, themes or plugins, including a site taken down by its own resource use
- Attacks directed at your individual site or account, rather than at our platform
- Problems outside our network, including your DNS, an expired domain, your internet connection, or a third-party service your site depends on
- Suspension or termination for non-payment or for breach of our Acceptable Use Policy
- Anything beyond our reasonable control, including a failure of the data centre's power or network, natural disaster, or an act of government
Service credits
Where monthly uptime for a service falls below 99.99%, you may claim a credit against that service's fee for that month:
| Monthly uptime | Roughly | Credit |
|---|---|---|
| 99.90% to 99.99% | 4 minutes to 43 minutes down | 10% of the monthly fee |
| 99.00% to 99.90% | 43 minutes to 7 hours down | 25% of the monthly fee |
| Below 99.00% | More than 7 hours down | 50% of the monthly fee |
Credits apply to the affected service only, and are calculated on what you actually paid for that service that month. If you pay annually, the monthly fee is one twelfth of the annual price. Total credits for any month will not exceed 100% of that month's fee for the affected service.
How to claim
Open a support ticket within 30 days of the end of the affected month, telling us which service and which month you are claiming for. We will check it against our monitoring and apply the credit to your Webfort account, where it is used against future invoices. Credits are not paid out in cash.
Your legal rights are unaffected
These credits are in addition to your rights under the Consumer Rights Act 2015 and any other rights you have in law. Nothing in this section limits those rights or prevents you from pursuing them.
3. Account Registration
To use our services, you must create an account by providing accurate and complete information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
- Ensuring your contact information remains current
3.1 Account Eligibility
You must be at least 18 years old to create an account. By creating an account, you represent and warrant that you meet this age requirement and have the legal capacity to enter into this agreement.
4. Payment Terms
All fees are stated in GBP (£) unless otherwise specified. Payment terms include:
- Billing Cycles: Monthly or annually, depending on the product. Domains are billed per registration term
- Payment Methods: Credit card, debit card, PayPal, and bank transfer
- Automatic Renewal: Services automatically renew unless cancelled before the renewal date
- Late Payments: Accounts with overdue payments may be suspended or terminated
4.1 Refund Policy
We offer a 60-day money-back guarantee on new hosting accounts — shared, WordPress, premium and reseller — and on WordPress Care. Domain registrations are non-refundable once registered, because the registry charges us at the point of registration and does not refund it. Refunds are processed within 7-10 business days.
4.2 Price Changes
We reserve the right to change our pricing at any time. Price changes will not affect existing customers until their next renewal period. We will provide at least 30 days' notice of any price increases.
5. Promotions & Programmes
These terms apply to our current offers and programmes. Where an offer conflicts with the rest of these Terms, this section governs that offer.
5.1 First Month for £1 (code FIRST)
New customers can take a first month for £1 on a hosting plan by entering the code FIRST at checkout. The offer is limited to one discounted month per customer, applies to the first billing period only, and cannot be combined with another discount code.
After the first month, the service renews automatically at the standard rate shown on the plan at the time you ordered, unless you cancel before renewal. The 60-day money-back guarantee in section 4.1 still applies; where a refund is due, we refund what you actually paid.
5.2 Switch Credit
If you move to us from another hosting provider, we may credit the unused balance of your existing plan against your Webfort account.
- Credit is calculated pro-rata on the remaining full months of your current term, based on what you paid for that term.
- You need to send us a recent invoice or billing screenshot from your current provider showing what you paid and when the term ends, so we can verify the balance.
- Credit applies to any Webfort hosting plan — shared, WordPress, Premium or reseller. It is applied to your account and used against future invoices.
- Credit has no cash value, cannot be transferred or withdrawn, and is not refundable under the 60-day money-back guarantee.
5.3 Free Hosting for Charities
Registered UK charities can apply for a free QuickStart hosting account. To qualify you must hold a registration number with the Charity Commission for England and Wales, OSCR in Scotland, or CCNI in Northern Ireland, and we will verify it against the public register.
- One free account per registered charity.
- The account stays free for as long as a working link to webfort.co.uk remains visible on your website.
- If the link is removed, we will contact you first. If it is not restored within 30 days, we may move the account onto our standard published pricing, giving you at least 30 days’ notice before any charge applies. We will not delete a charity’s website for removing the link.
- Domain registration is not included and is charged at our standard rates.
- These Terms and our Acceptable Use Policy apply in full.
5.4 Affiliate Programme
Our affiliate programme pays a flat £20 commission for each qualifying sale referred through your unique affiliate link.
- A qualifying sale is a new customer, who has not held a Webfort account before, purchasing a web hosting or WordPress hosting plan.
- Referrals are tracked by cookie for 90 days from the click.
- Commission is paid 60 days after the sale, once the money-back guarantee period has passed, by PayPal or bank transfer. There is no minimum payout threshold.
- Self-referrals do not qualify, and commission on them will be voided.
- We may withhold or reclaim commission where a sale is refunded or charged back, or where referrals are generated by spam, misleading claims about Webfort, paid search on our brand terms, or any other practice that breaches these Terms or the law.
- Affiliates must disclose the commercial relationship wherever they promote us, as required by the CAP Code and consumer protection law.
We may change or end the programme on 30 days’ notice. Commission already earned at that point will still be paid.
6. Acceptable Use Policy
You agree not to use our services for any unlawful or prohibited activities, including but not limited to:
- Hosting illegal content or engaging in illegal activities
- Distributing malware, viruses, or other harmful code
- Sending spam or unsolicited bulk emails
- Hosting phishing sites or engaging in fraudulent activities
- Infringing on intellectual property rights
- Running IRC bots, file sharing services, or proxy servers (unless explicitly permitted)
- Mining cryptocurrency without prior written authorization
- Using excessive server resources that negatively impact other users
⚡ Resource Usage
Shared hosting accounts are subject to fair usage limits. Accounts consistently exceeding resource allocations may be asked to upgrade to a higher-tier plan.
6.1 Content Responsibility
You are solely responsible for all content hosted on your account. We do not monitor customer content but reserve the right to remove content that violates these Terms or applicable laws.
7. Termination
Either party may terminate this agreement at any time:
- By You: Cancel your services through your account dashboard or by contacting support
- By Us: We may suspend or terminate your account for violations of these Terms, non-payment, or illegal activities
7.1 Effect of Termination
Upon termination, your access to services will cease. You are responsible for backing up your data before cancellation. We are not responsible for data loss following account termination. Apart from the 60-day money-back guarantee in section 4.1, and any refund we owe you in law, we do not refund part-used billing periods.
8. Limitation of Liability
To the maximum extent permitted by law, Webfort shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Service interruptions or data loss
- Third-party actions or content
Our total liability for any claims arising from these Terms or our services shall not exceed the amount you paid us in the 12 months preceding the claim.
8.1 Backups
We take daily backups of your hosting account and keep them for 30 days, and you can restore from them yourself in the control panel. We cannot guarantee that any individual backup will be present or will restore successfully, so we do not accept liability for data loss and you remain responsible for keeping your own copy of anything you cannot afford to lose. If a restore does fail, tell us and we will do what we can to help.
8.2 Third-Party Services
Our services may integrate with third-party services. We are not responsible for the availability, accuracy, or reliability of any third-party services.
